1. About these terms

These Terms of Use (Terms) are a legal agreement between you and (ACN 665 357 700) trading as “Money Playbook” (we, us or our) and govern your access to and use of:

  • the website at moneyplaybook.com.au (Website);
  • the Money Playbook application at moneyplaybook.app (App); and
  • our financial education e-learning program, video lessons, workbooks, calculators, tools, quizzes, simulations and related resources (Program), (together, the Services).

By accessing or using any part of the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Services.

2. Definitions

  • Content means all material made available through the Services, including lessons, videos, workbooks, calculators, tools, quizzes, simulations, text, graphics, designs, logos, software and data.
  • Institution means a school, business or organisation that engages us to make the Program available to its students, staff or members.
  • User, you means any person who accesses or uses the Services, including students, teachers, Institution staff, individual purchasers and other visitors.
  • Intellectual Property Rights means all current and future intellectual property rights, including copyright, trade marks, designs, patents, and rights in confidential information and know-how, whether registered or unregistered.

3. Eligibility, students and users under 18

  • The Program is generally delivered through an Institution. Where an Institution provides your access, your use is also subject to that Institution’s arrangements, supervision and policies.
  • If you are under 18, you may only access and use the Services with the consent and supervision of a parent, guardian or Institution. By using the Services, you confirm you have that consent.
  • A parent, guardian or Institution who permits a person under 18 to use the Services is responsible for supervising that use and agrees to these Terms on that person’s behalf.
  • You must provide accurate information and must not access the Services if you are prohibited from doing so under applicable law.
  • We may refuse, suspend or terminate access to any User at our discretion, including where we reasonably believe these Terms have been breached or to protect the Services, other Users or us.

4. Accounts and security

  • Some Services require an account. You must provide accurate, current and complete information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised access or use.
  • Where accounts are created for students or staff by an Institution, the Institution is responsible for managing those accounts and for its Users’ compliance with these Terms.
  • You must not share, sell or transfer your account or access, or allow others to use it.

5. IMPORTANT – General advice warning and educational purpose

Money Playbook provides financial education only. It does not provide personal financial advice.

  • All Content, lessons, calculators, tools and outputs are general in nature and do not take into account your objectives, financial situation or needs.
  • To the extent any information could be considered financial advice, it is General Advice only. Our financial education is developed with input from qualified financial advisers who are licensed by, or authorised representatives of an entity licensed by, the Australian Securities and Investments Commission (ASIC). We do not provide personal financial advice, and we do not provide advice on specific financial products.
  • Before acting on any information from the Services, you should consider its appropriateness having regard to your own objectives, financial situation and needs, and obtain advice from a licensed financial adviser and, where relevant, independent tax, legal or accounting advice.
  • Calculators, tools and projections are illustrative and may be inaccurate, incomplete or based on assumptions that do not apply to you. Outputs are estimates only and are not predictions, guarantees or recommendations. You must not rely on them when making financial decisions.
  • We do not guarantee any particular financial or educational outcome from the Services, and past performance is not indicative of future results.

6. Licence to use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Content solely:

  • for your own personal, non-commercial educational use; or
  • where you are an Institution, for delivering the Program to your enrolled students, staff or members in accordance with your agreement with us.

This licence continues only while you comply with these Terms.

7. Acceptable use

You must not, and must not permit any other person to:

  • use the Services in breach of any law, these Terms, or the rights of any person;
  • copy, reproduce, adapt, distribute, sell, resell, publish, broadcast, publicly display or create derivative works from the Content, except as expressly permitted;
  • share account access or distribute Program materials to any person who is not an authorised User;
  • upload, submit or transmit any unlawful, harmful, defamatory, infringing, misleading or offensive material, or any Sensitive Information (see section 8);
  • introduce any virus, malware or harmful code, or attempt to gain unauthorised access to, interfere with, damage, disrupt or circumvent the security of the Services or any systems or networks;
  • use any automated means (including scraping, crawling or data mining) to access or extract Content without our written consent;
  • reverse engineer, decompile or disassemble any part of the Services except to the extent permitted by law; or
  • use the Services to harass, harm, impersonate or mislead any person, or for any fraudulent or unlawful purpose.

We may investigate suspected breaches, remove Content, and suspend or terminate access, and we may report unlawful conduct to authorities.

8. Sensitive and personal information

The Services are educational and are not designed to collect real, detailed personal financial information or any Sensitive Information (such as health information). You must not submit Sensitive Information through the Services, and any figures you enter into tools should be hypothetical or illustrative. We may remove or de-identify information that appears to be Sensitive Information. Our handling of Personal Information is described in our Privacy Policy.

9. Intellectual property

All Content and all Intellectual Property Rights in the Services are owned by or licensed to us and are protected by law. Except for the limited licence in section 6, nothing in these Terms transfers any Intellectual Property Rights to you. You must not use our name, logos, trade marks or branding without our prior written consent. You grant us a non-exclusive, royalty-free, perpetual licence to use feedback, suggestions and testimonials you provide, and (where you consent) to attribute testimonials to you or your Institution.

If you believe Content infringes your Intellectual Property Rights, contact us with details and we will review the matter and, where appropriate, remove the Content.

10. Fees, purchases and Institutions

  • Where the Program or other products are purchased, pricing, inclusions and payment terms are as set out in your order, quote or agreement with us. The Program is generally priced per participating student.
  • You agree to pay all applicable fees, together with any taxes. Unless stated otherwise, fees are exclusive of GST, which will be added where applicable.
  • We may change our pricing from time to time; changes do not affect orders already accepted by us.
  • Where an Institution purchases on behalf of students or staff, the Institution is responsible for payment and for its Users’ compliance with these Terms.
  • The moneyplaybook.app access may involve a subscription billing arrangement upon purchase, which renews automatically. You can cancel any subscriptions anytime within the application, or by emailing james@moneyplaybook.com.au

11. Refunds and Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage; for failures that do not amount to a major failure, you are entitled to have the problem remedied within a reasonable time and, if this is not done, to a refund. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot be excluded under the ACL.

Subject to your rights under the ACL, and except where required by law, fees paid for the Program, digital resources, subscriptions and access to the Services are non-refundable (for example, we do not provide refunds for change of mind or for failure to use the Services). If you believe there is a problem with the Services, contact us and we will work with you to resolve it.

12. Third-party services

The Services may link to, integrate with, or rely on third-party websites, tools or services that we do not control. We are not responsible for third-party content, products or services, and your use of them is at your own risk and subject to their terms and privacy policies.

13. Disclaimers

To the maximum extent permitted by law:

  • the Services and Content are provided “as is” and “as available”, without warranties or representations of any kind, whether express or implied, including as to accuracy, completeness, currency, reliability, suitability or fitness for a particular purpose;
  • we do not warrant that the Services will be uninterrupted, timely, secure or error-free, or that defects will be corrected; and
  • we are not responsible for any decision you make, or any loss you suffer, in reliance on the Content, calculators, tools or any general information provided through the Services.

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law:

  • we (and our directors, employees, contractors and agents) are not liable to you for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with the Services or these Terms, whether in contract, tort (including negligence), statute or otherwise; and
  • our total aggregate liability to you arising out of or in connection with the Services or these Terms is limited, at our option, to (a) re-supplying the relevant Services or paying the cost of having them re-supplied, or (b) the total amount you paid us for the relevant Services in the 12 months immediately before the event giving rise to the liability.

Where our liability cannot be excluded but can be limited under the ACL, our liability is limited as set out above to the extent permitted. Nothing in these Terms limits liability that cannot lawfully be limited.

15. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold us (and our directors, employees, contractors and agents) harmless from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Services; (c) your infringement of any law or the rights of any person; or (d) any Content or information you submit. This indemnity does not apply to the extent the loss is caused by our own negligence, fraud or wilful misconduct, or is a liability that cannot lawfully be excluded.

16. Availability, changes and suspension

We may modify, update, suspend, restrict or discontinue any part of the Services at any time, with or without notice. We will try to give reasonable notice of significant changes where practicable. We are not liable for any unavailability, modification or discontinuation of the Services or any Content.

17. Termination

We may suspend or terminate your access to the Services immediately if you breach these Terms, or if we reasonably consider it necessary to protect the Services, other Users, or us. You may stop using the Services at any time. On termination, your licence to use the Services ends and you must cease using and destroy any downloaded Content, but any provisions that by their nature should survive termination (including sections 5, 8, 9, 13, 14, 15, 18 and 20) will continue to apply.

18. Force majeure

We are not liable for any failure or delay in performing our obligations where the failure or delay is caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, failures of telecommunications or internet providers, power failures, cyber-attacks, industrial action, or government actions.

19. General

  • Governing law and jurisdiction. These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.
  • Dispute resolution. Before commencing proceedings (except for urgent injunctive relief), you agree to first contact us and attempt to resolve the dispute in good faith.
  • You must not assign or transfer your rights under these Terms without our consent. We may assign or novate our rights and obligations, including in connection with a sale or restructure of our business.
  • If any provision of these Terms is held to be invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions continue in full force.
  • A failure or delay by us to exercise a right does not operate as a waiver of that right.
  • Entire agreement. These Terms, together with the Privacy Policy and any order or Institution agreement, constitute the entire agreement between you and us in relation to the Services and supersede any prior representations or agreements.
  • We may give notices via the Website, App, or by email to the address associated with your account.

20. Changes to these Terms

We may update these Terms from time to time. The current version will be available on the Website and App, and changes take effect when published. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Services after changes are published constitutes acceptance of the updated Terms.
